Certificate of conformity to Technical regulations

Certification [under the Federal Law № 184-ФЗ "About technical regulation"] is a form of conformity assessment implemented by certification body to requirements of technical regulations, standards, codes of practice or the terms of contracts.

Obligatory conformity assessment is realized only in cases specified by the relevant technical regulations, and exclusively on the requirements of the technical regulations.

If the manufacturer certifies its products according technical regulations, it proves that its product, on which issued the certificate, meets certain safety requirements and, accordingly, the manufacturer has a competitive advantage.

Conformity assessment procedures (certification or declaration) are set only technical regulations according to the degree the risk of failing to achieve purposes of the technical regulations.

The declaration of conformity and certificate of conformity have equal legal force.

Obligatory certification by certification body is realized on the basis of an agreement with the applicant. Conformity assessment scheme used for the certification of certain products, are established by relevant technical regulations and are specified certification body after receiving the necessary documents from the applicant.

The typical list of documents to be used when performing work on conformity and determine the requirements for these works:

• business name and full address of the manufacturer and, where appropriate, his authorised representative;
• description and identification of the machinery, including generic denomination, function, model, type, serial number and commercial name;
• the safety case;
• operational documents (passport, operation manual, installation and maintenance manual);
• a list of standards which these machines and (or) equipment have to conform to requirements (when used by the manufacturer);
• the contract (supply contract) (for the party, a single product), or shipping documentation (for the party, a single product);
• certificate quality management system of the manufacturer (if available);
• information about the investigations (if any);
• machine and (or) equipment testing protocols of the manufacturer, seller or person executing functions of the foreign manufacturer, and (or) test laboratories (centers) (if any);
• certificates of compliance for materials and components and protocols of their tests (if any);
• certificates of conformity for these machines and (or) equipment provided by foreign certification bodies (if any);
• other documents, directly or indirectly, confirming compliance with the machines and (or) equipment safety requirements of these technical regulations (if any).

If the applicant has a certificate of conformity requirements of the Technical Regulation, he does not need to get RTN Permit use, but it does not exempt from necessity of carrying out the examination of industrial safety.

A number of technical regulations from the Customs Union of Russia, Belarus and Kazakhstan are came into effect since 15 February 2013.

The conformity assessment procedure (certification and declaration) of certain types of products has received a number of features. Certification Procedure for conformity assessment is given in the diagram below (download the block diagram).

For example, according to the Technical Regulations of the Customs Union TR CU 010/2011 "On the safety of machines and equipment" it requires an obligatory confirmation of conformity of all cranes, loader cranes, pipelayer cranes, etc. in the form of certification, and accessories for lifting operations, wire rope and chain electric hoist , etc. in the form of declaration.

Regulations contains mandatory for the application and execution of requirements for safety. It contains standards containing specific technical decisions to implement these requirements for specific types of machinery and equipment.

Feature of the Regulations is the requirement of supply a safety case, which is developed for the design of machines and (or) equipment, and accompanies products at all stages of its life cycle. The safety case defines the principles and design features, compliance with which provides the necessary security, and the need for risk assessment after overhauled machines and (or) equipment whose value must not be higher then permissible. The safety case is the same as the technical file in accordance with Directive 2006/42/EC "On machinery" (see Annex VII).

One more feature is to determine the the applicant. At certification the applicant now can be only registered in accordance with the legislation of the member state of the Customs Union in its territory a legal entity or a natural person as an individual entrepreneur:

• or a manufacturer;
• or a seller (for the party);
• or person performing the functions of the foreign manufacturer in a contract with him.
Latter point can affect the choice of the certification scheme or declaring. For example, can not be selected scheme 9c to certify the party products in the absence at manufacturer an authorized representative. In general terms, a conformity assessment of imported equipment has its own features that you should consider as early as before buying.

Certificate validity period of conformity is established no more than 5 years for the serial produced machinery, and (or) equipment. Period is not set for the products party. Periodically if it is provided by the certification scheme, the certification body shall carry out the inspection control of the certified products.

Requirements of Technical Regulation TR CU 016/2011 "On safety devices, operating on fuel gas" during certification of gas-powered equipment, are in something similar to the above, but have some differences.

Certification body «TEST ENGINEERING Ltd.» is included in the Unified Register of certification bodies and testing laboratories (centers) of the Customs Union.
